Important Binding Contract: By registering an account, utilizing PubVelo monetization infrastructure, or generating utility links (Bio Links, Cloud File Distribution Links, Notes, Giveaways, Quizzes, Polls, or Short URLs), you acknowledge that you have read, understood, and agree to be bound by this Agreement, our Privacy Policy, and DMCA Policy.
1. Intermediary Status & Legal Safe Harbor (Section 79 IT Act & DMCA)
PubVelo operates strictly as an Intermediary and Technology Service Provider under Section 79 of the Information Technology Act, 2000 (India), the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Millennium Copyright Act (17 U.S.C. § 512).
PubVelo provides automated digital utilities allowing registered users to create link hubs, store temporary files, host quizzes, and share notes. You explicitly understand that:
- No Content Generation: PubVelo does not initiate transmissions, select receivers of transmissions, or modify content contained in user uploads or shared links.
- No Pre-Screening: User content is generated and hosted autonomously without prior editorial review or human screening by PubVelo.
- Statutory Safe Harbor: PubVelo claims full statutory safe harbor immunity from civil and criminal liability for user-submitted content, provided we act expeditiously upon receiving valid court orders, government notices, or DMCA takedown requests.
2. Zero-Tolerance Prohibited Content Rules
PubVelo enforces a strict, uncompromising zero-tolerance policy against malicious, illegal, or harmful content. You strictly agree NOT to upload, distribute, link to, or monetize:
Absolute Ban on Adult & Sexually Explicit Content (18+)
Pornography, adult videos, nude photos, NSFW materials, escort service links, non-consensual sexual content, or links directing to adult websites are strictly forbidden. Any account found hosting or linking to adult content will be permanently banned with zero prior warning, immediate file purging, and 100% forfeiture of all earnings.
- Malware & Phishing: Ransomware, spyware, trojans, viruses, phishing pages, credential stealers, or exploits.
- Hate Speech & Violence: Content promoting terrorism, violent extremism, communal hatred, harassment, or self-harm.
- Illegal Goods & Narcotics: Sale or promotion of illegal drugs, regulated substances, firearms, weapons, or illicit gambling.
- Fraud & Financial Scams: Ponzi schemes, fake investment portals, carding tools, or deceptive short links.
3. Copyright Protection, Movies & Anti-Piracy Policy
PubVelo is dedicated to protecting intellectual property rights and adheres strictly to Indian Copyright Act, 1957, WIPO Copyright Treaty, and international copyright conventions.
- Pirated Movies & Music Ban: Users must not upload, share, or link to pirated movies, TV series, unreleased songs, cracked commercial software (warez/keygens), game ROMs, or unauthorized OTT media streams.
- Immediate Takedown: When a verified copyright owner or authorized representative files a valid DMCA or Copyright Takedown Notice, PubVelo acts immediately to disable and purge the infringing links or files.
- Repeat Infringer Penalties: Accounts with multiple copyright violations will be permanently terminated, and all unpaid earnings generated via infringing content will be 100% forfeited.
4. Child Abuse & CSAM Mandatory Law Enforcement Reporting
PubVelo strictly prohibits any Child Sexual Abuse Material (CSAM), Child Sexual Exploitation and Abuse (CSAE), or underage content of any sexual nature under the Protection of Children from Sexual Offences (POCSO) Act, 2012, the Indian Penal Code / Bharatiya Nyaya Sanhita, and international criminal statutes.
Mandatory Law Enforcement & NCMEC Reporting
Upon discovery or notification of CSAM, PubVelo will immediately purge the content, freeze user account telemetry (including IP logs, device headers, and email address), and proactively submit formal reports to the National Crime Records Bureau (NCRB) / Cyber Crime Reporting Portal (cybercrime.gov.in), international police agencies, and the National Center for Missing & Exploited Children (NCMEC).
5. User Responsibility, Warranties & Indemnification
You represent and warrant that you hold all required legal rights, licenses, and permissions for all content, text, media, and external URLs hosted on or routed through PubVelo.
- Sole Legal Liability: You assume 100% full legal, civil, and criminal liability for any content uploaded to your account.
- Indemnification Clause: You agree to defend, indemnify, and hold harmless PubVelo, its parent entity, directors, officers, employees, and software architects against any claims, losses, damages, liabilities, penalties, legal fees, or court costs resulting from your violation of this Agreement, third-party intellectual property infringement, or regulatory breach.
6. Giveaways, Quizzes & Promotional Tools Governance
PubVelo provides promotional utilities (such as Giveaways /g/, Quizzes /q/, and Polls /p/). The following conditions apply:
- Platform Neutrality: PubVelo is a technical facilitator. The registered creator who creates a giveaway or quiz is solely responsible for lawful operation, transparent winner selection, and actual prize fulfillment.
- Anti-Fraud & Fair Play: Participants must not use automated bot scripts, fake email generators, or fraudulent proxy networks to submit multiple illegitimate entries. Suspicious entries are subject to automated disqualification.
- Participant Data Consent: Participants entering giveaways explicitly consent to submitting required verification details (Name, Contact Email, Phone, Social Handles) for entry verification, winner announcement, and public leaderboard transparency.
7. Google Demand Partner Final Authority & 100% IVT Deductions
PubVelo provides ad monetization infrastructure connected directly to **Google Ad Manager (GAM)**, **Google AdSense**, and upstream programmatic exchanges.
Estimated vs. Final Audited Revenue
All revenue figures displayed inside the PubVelo publisher dashboard during an active calendar month are strictly provisional estimates. Final payable earnings are calculated ONLY after Google and upstream demand partners complete their post-month-end forensic audit and release finalized disbursement records.
- 100% Pass-Through of Invalid Traffic (IVT) Deductions: If Google Ad Manager or any upstream partner flags Invalid Clicks, Bot Impressions, Auto-Refresh exploits, VPN farms, or policy violations on your property, **100% of the resulting revenue deduction, discount, or clawback will be applied directly to your publisher ledger.**
- Zero Platform Liability for Withheld Google Funds: If Google withholds, claws back, delays, or cancels earnings associated with your website, app, or tool links due to traffic quality or policy failures, **PubVelo has ZERO legal obligation or liability to pay out uncollected, clawed-back, or deducted funds.**
- Binding Nature of Upstream Audits: Google's traffic quality determinations, deduction statements, and invalid click audit logs are definitive, final, and non-negotiable.
8. Zero Payout on Legal Violations, Account Dormancy & Net-30 Terms
Publisher earnings settlement is governed by strict compliance and anti-fraud protocols:
100% Forfeiture of Earnings for Legal or Policy Violations
If an account is suspended or permanently terminated due to **Adult/Pornography hosting, Movie/Media Piracy, Copyright Infringement, Child Exploitation (CSAM), Malware distribution, Ad Fraud, or receipt of valid Law Enforcement directives**, **ALL pending, unpaid, and accrued balances are immediately and permanently 100% FORFEITED with zero payout settlement.**
- Net-30 Payout Terms: Verified and compliant publisher balances meeting minimum thresholds ($50 for Apps / $100 for Websites) are disbursed on standard Net-30 schedules.
- Account Inactivity & Dormancy Rule: Accounts that remain inactive, unverified, or fail to submit valid payout/tax documentation for more than **12 consecutive months** will have their accrued unclaimed balances classified as dormant and subject to administrative closure.
- Tax Deductions (TDS/GST): Payouts to Indian publishers are subject to statutory TDS deduction under Indian Income Tax Act Section 194C/194J. Form 16A certificates are issued quarterly.
9. Termination, Compliance & Governing Law
PubVelo reserves the right to suspend, terminate, or delete any account immediately without prior notice for violations of these Terms, traffic manipulation, or receipt of valid law enforcement directives.
Governing Law & Jurisdiction: These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India. Any legal disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of competent courts in India.
